Welcome to Empyrean. By accessing or using our website at getempyrean.com and purchasing our products, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By placing an order with Empyrean, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

2. Product Descriptions

We take care to ensure our product descriptions, images, and specifications are accurate. However, we do not warrant that product descriptions or other content on this site are error-free, complete, or current. If a product is not as described, your sole remedy is to return it in unused condition in accordance with our Refund Policy.

3. Pricing

All prices are displayed in New Zealand Dollars (NZD) and are inclusive of GST where applicable. We reserve the right to change prices at any time without notice. Promotions and discounts cannot be applied retroactively.

4. Payment

Payment is processed securely through Shopify Payments. We accept major credit and debit cards. Payment is required in full at the time of purchase. We do not store your payment details.

5. Shipping

We ship to New Zealand and Australia. New Zealand orders use NZ Post Courier Parcel with standard delivery at $6.99 NZD and free shipping on orders over $30 NZD. Australian orders use NZ Post International Economy Tracked at a flat rate of $24.99 NZD. Delivery to New Zealand typically takes 2 to 5 business days. We do not ship to countries outside New Zealand and Australia. We are not responsible for delays caused by circumstances outside our control.

6. Returns and Refunds

We accept returns for damaged or faulty items only. We do not accept change of mind returns. Your rights under the Consumer Guarantees Act 1993 are not affected by these terms.

7. Consumer Guarantees Act 1993

Under the Consumer Guarantees Act 1993, products must be of acceptable quality, fit for purpose, match their description, and be free from defects. These statutory rights are not limited by our policies.

8. Fair Trading Act 1986

We are committed to honest and accurate advertising and do not engage in misleading or deceptive conduct as prohibited by the Fair Trading Act 1986.

9. Intellectual Property

All content on getempyrean.com, including text, images, logos, and design elements, is the property of Empyrean and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Empyrean shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability for any claim shall not exceed the purchase price of the product giving rise to the claim.

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our website after changes constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
